Rules and conditions of marriage in Islam

Marriage is a special blessing of Allah and an important Sunnah of the Prophet (peace be upon him). An incomparable tool to prevent character degradation. Ideal family formation, human biological needs, and human peace are the main ingredients. Marriage is an important provision of Islamic law.

In the Holy Qur'an, Allaah says (interpretation of the meaning): "One of the signs of Allaah is that He has created for you mates from among yourselves, so that you may find peace in them, and He has created between you, mutual love, affection, and kindness." , Verse: 21)
A brief discussion was given on all the rules and regulations of Islam and its provisions and related issues.

Rukn or basic basis of marriage in Islam:

One. Freeing the bride and groom from all kinds of obstacles when it comes to marriage.
Two. Ijab or proposal: This is to present the marriage proposal to the groom on behalf of the girl's guardian or her representative. For example, ‘I married such and such to you’ or any other such proposal.
Three: Acceptance: This is the consenting sentence of the groom or his representative. E.g., ‘I accepted’.

The condition for marriage to be pure:

(1) To specify both the bride and groom in an acceptable manner.

(2) The bride and groom should be satisfied with each other. The Prophet (peace and blessings of Allaah be upon him) said, ‘Husbandless women (widows or divorcees) cannot be married without her decision (i.e., she has to be told clearly). A virgin girl cannot be married off without her consent (through words or silence). People asked, O Messenger of Allah (peace be upon him)! How do I know his consent? He said, "His consent is to remain silent (out of shame)." (Bukhari, Hadith No. 4741)

(3) The guardian of the daughter has to fulfill the responsibility of arranging the marriage contract. Since Allah has issued instructions to the parents to get married. Allaah says (interpretation of the meaning): “And marry unmarried men and women among you.” (Surah Noor, 24:32)

The Prophet (peace and blessings of Allaah be upon him) said, ‘A woman who marries without the permission of her guardian has her marriage annulled, her marriage annulled, her marriage annulled.’ (Tirmidhi, Hadith No. 1021)

(4) Witnesses must be kept during the marriage ceremony. The Prophet (peace and blessings of Allaah be upon him) said, ‘There is no marriage without a guardian and two witnesses.’ (Saheeh Jame, hadeeth no. 6557)

Witnesses must be two male (independent) witnesses or one male (independent) and two female witnesses who can hear both the preamble and the confession. (Ad-Durrul Mukhtar-3/9; Fatwa Hindi-1/26)

It is also important to ensure the promotion of marriage. The Prophet (peace and blessings of Allaah be upon him) said, ‘Declare the matter of marriage.’ (Musnad Ahmad, Hadith No. 1062)

Conditions for being the guardian of the bride:

1. Having a healthy brain.
2. Becoming an adult.
3. Freed from the shackles of slavery.
4. The guardian is to follow the religion of the bride. So no non-Muslim person can be the guardian of Muslim men and women.
5. To be fair That is, not to be a transgressor. Some scholars have imposed this condition. Others have called the external ‘court’ (piety) enough. Again, according to some, the welfare of the person he is marrying should be considered.
6. To be a man. The beloved Prophet (peace and blessings of Allaah be upon him) said, ‘One woman cannot marry another woman. Or women cannot marry themselves. The adulteress marries herself. '(Ibn Majah, Hadith No. 162; Sahih Jame: 6296)
7. To be able to consider the ‘kufu’ or equality and other welfare aspects of the bride and groom in case of marriage.

The jurists have determined the line of guardians. So the guardianship of a distant guardian is not acceptable to have a close guardian. If there is no close guardian, a distant guardian will be acceptable.
